These Terms of Service ("Terms") govern your use of the MusePin mobile application and related services ("Service") operated by MusePin ("we", "our", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years of age to use MusePin. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. The Service is not intended for children under 13.
2. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate registration information and to update it as needed. You must notify us promptly at support@musepin.com if you suspect unauthorised access.
3. User-Generated Content
Your content
You may upload photos (outfits, profile images), post content, and interact with other users' content. You retain ownership of content you create. By posting content on MusePin, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute your content solely to operate, promote, and improve the Service.
Content standards
You agree that your content will not violate applicable law or infringe others' rights. Content should be appropriate for a fashion and lifestyle community.
4. Prohibited Conduct
You may not:
- Harass, abuse, threaten, or impersonate others
- Upload unlawful, obscene, defamatory, or hateful material
- Attempt to gain unauthorised access to accounts, systems, or data
- Use the Service to distribute malware, spam, or unsolicited communications
- Scrape, reverse engineer, or interfere with the normal operation of the Service
- Use the Service for any illegal purpose
5. Intellectual Property
The MusePin name, logo, app design, and other branding are owned by MusePin or its licensors. You may not use our trademarks or branding without prior written permission, except as permitted by law for nominative reference.
6. Stylists and Bookings
MusePin may facilitate connections between users and independent fashion stylists. Stylists are independent third parties; any booking or consultation is between you and the stylist. We do not guarantee stylist availability, quality of advice, or outcomes. You are responsible for verifying stylist credentials and terms before engaging services.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.
8. Limitation of Liability
To the fullest extent permitted by law, MusePin and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the Service. Our aggregate liability for claims relating to the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred euros (€100), if you have not paid us.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.
9. Termination
You may stop using the Service and delete your account at any time through the app settings. We may suspend or terminate your access if you violate these Terms or if we reasonably believe it is necessary to protect users or the Service. Provisions that by their nature should survive (including licences granted to us for content already distributed, disclaimers, and limitations of liability) will survive termination.
10. Changes
We may modify these Terms from time to time. We will provide notice of material changes through the app or by email where appropriate. Continued use after changes become effective constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws applicable in your primary place of residence, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country apply and cannot be waived.
